CYPRESS LANDING TRAILER PARKING FACILITIES

 

These guidelines are intended to reflect the intent and be consistent with the Cypress Landing Covenants and may be modified, interpreted accordingly.

 

1- Definition/Responsibility 

The storage areas described herein are as referenced in the Cypress Landing Protective Covenants; page 22, paragraph 17.  These storage areas come under the direct responsibility of the Cypress Landing Master Home Owners Association (CLHOA).  Responsibility for the “day-to-day” administration of these facilities is assigned to the Community Association Manager (CAM) who is located at the Bay Club.  On-going operational guidance will be provided by the Buildings and Grounds Committee on behalf of the CLHOA.   

Storage Area “A” (spaces #1 through #56) and storage area “B” (spaces #57 through #101) are accessed via the gravel road just off Old Blount’s Creek Road. 

Storage Area “C” (spaces #102 through #160 is located off Cypress Landing Trail, in the general vicinity of the Fitness Center. 

Only CURRENTLY registered, licensed and insured items will be permitted in the storage areas. 

In addition, all items stored are required to be properly maintained and in working order.  Owners of items that are unsafe for use on the road or water, will receive a 30 day notice to repair their stored item or remove said item and relinquish the storage space.  Examples are, but not limited to; flat tire(s), un-seaworthy vessel, vehicles with expired inspection stickers, torn cover/canopy or items that are in general disrepair. 

It is the specific responsibility of authorized users of these storage areas that all information on the storage “application” is current and complete at all times and that a signed liability waiver is on file.  Any change in storage information or intended usage shall be immediately provided to the CAM. 

2- Authorized Users/Cost: 

The storage areas are intended for the sole use of lot and living unit owners within Cypress Landing and shall be available at no cost.  (Protective Covenants; page 22, paragraph 17).  Notwithstanding, a lot or living unit owner’s space may be authorized for use by his/her “renter”.  (For “additional storage needs” see below.) 

3- Space Allotment/Assignment/Additional Storage 

Storage will be limited to one (1) space per Cypress Landing property owner regardless of how many lots or living units owned on a first come first served basis.   If there is a need for additional storage, and space is available, arrangements may be made through the CAM, for additional temporary space, in three (3) month increments, based upon availability and the overall total needs of the community.  Spaces will be assigned by the CAM and will be based upon the overall best utilization of the trailer parking facilities.  Once a space is assigned, that area will be designated for the sole use of the lot or living unit owner/renter to whom it is assigned and subject to reassignment by the CAM, when necessary.  The CAM may reassign spaces in the interest of the best overall utilization of the facility at any time.  The space holder will be notified in advance, whenever possible.  In the interest of safety, the CAM may move items without prior notification.  Under no circumstances may any storage space be sublet/ utilized by anyone not specifically authorized to do so. 

It is recognized that individual usage may vary with the season, and in those cases where authorized users will be away for extended periods of time, arrangements may be made, through the CAM, for the temporary use of their space by another authorized user.  If within a 12-month period a storage space is not utilized, the space will automatically be relinquished and made available for reassignment. 

All vehicles/items in storage must be on the storage “application” with a signed liability waiver on file in the CAM office.  If a vehicle/item is out of place and/or not stored correctly and/or not on the storage “application”  the space holder will be it is subject to remedial actions as stated in the Cypress Landing Protective Covenants. 

4- Storage Restrictions: 

As previously stated, storage is limited to one (1) space per lot or living unit owner, except as described in Section 3 and is specifically limited to the following items: boats, boat trailers, personal water craft, RV’s and personal utility trailers.  Personal (i.e. non-commercial) trucks are only permitted on a “space available” basis, see Section 3.  Authorized users are permitted to alternate the item(s) being stored in their designated space as long as all information is current and accurately reflected on the storage “application” on file in the CAM office. 

Each storage area is generally defined as the area between the two fence posts in which the storage lot number is posted and extends 36 feet into the storage lot as measured from the fence line.  Stored item(s) are not to exceed 36 feet in length or be too wide to fit between the fence posts thereby encroaching on the adjacent space(s). 

Additionally, some spaces (ex: corner spaces and spaces near the entrance gates) will not accommodate the largest item(s) allowed – under no circumstance should a stored item block the gates, access to another storage space or the storage shed.  Should a user realize their stored item(s) blocks another’s use of the storage facilities, the user should contact the HOA office and exchange their space for a different space before storing said item(s). 

The storage of cars and commercial (used for business) vehicles/trailers is specifically prohibited.  The ongoing storage of items, not belonging to the designated lot owner/renter, will not be permitted and subject to remedial actions as stated in the Cypress Landing Protective Covenants. 

5- Guest usage

When requested by a lot or living unit owner, the CAM will endeavor to accommodate overnight or short-term (up to two weeks) visitors who need a parking space for a boat, boat trailer, personal water craft, RV or personal utility trailers.  The “guest” will need to show proof of insurance and sign the liability waiver.  If an additional key is needed, the “guest” will be required to provide a $25 key deposit. 

6- Access/Utilization/Cancellation: 

Requests/applications for space should be directed to the CAM.  If available and following the submission of a completed application, a space will be assigned to the applicant.  Successful applicants will be required to provide a $25.00 key deposit.  This deposit will be returned by a check upon the return of the access key and written notification to the CAM of the cancellation of the need for a storage space.  Record keeping for key deposits/returns is the responsibility of the CAM. 

Lost keys will require an additional $25.00 deposit and forfeiture of the original deposit.  Locks will be re-keyed as needed and authorized users will be notified in advance.  When notified, users may pick up their new key at the CAM’s office, return the old key and are to reconfirm current storage information in their file. 

Note:  If a space is not available, the applicant will be placed on a “wait list” and will be notified by the CAM when a space is available. 

7- Audit 

The contents of all storage areas will be audited at least twice annually by the CAM in conjunction with the Buildings & Grounds Committee.  Users of the storage areas are requested to notify the CAM when a space is no longer required or when the item(s) being stored differ from what is shown on file.  This excludes the anticipated transfer of boats from the storage areas to the marina, etc. 

8- Maintenance 

The storage areas are intended to be a “no cost” amenity.  You may be contacted at the discretion of the CAM to move your trailer, etc. and requested to assist with maintenance and/or the clearing of weeds/trash, etc. in the storage area you are utilizing. 

9- Security 

Users of the storage area are responsible to report any apparent breach of security in a timely fashion to the CAM during working hours and to Sheriff at other times.  Do not loan your key to others and report lost keys as soon as possible.  It is our storage facility and contains valuable property.  If the pole lights are not working, note the # on the tag affixed to the pole and notify the CAM and/or the power company ASAP.
