STORGE FACILITIES
GUIDELINES

These guidelines are intended to reflect the intent and be consistent
with the Cypress Landing Covenants and may be modified, interpreted
accordingly.
1- Definition/Responsibility
The kayak/canoe storage areas are located along the boardwalk and
within the enclosure containing the dumpster. These storage areas come
under the direct responsibility of the Cypress Landing Master Home
Owners Association (CLHOA). Responsibility for the “day-to-day”
administration of these facilities is assigned to the Community
Association Manager (CAM) who is located at the Bay Club. On-going
operational guidance will be provided by the Buildings and Grounds
Committee on behalf of the CLHOA.
The storage areas are intended for the sole use of property owners
within Cypress Landing and shall be available at no cost.
2- Contact/Supervision
Applications for spaces will be filed with the CAM (phone: (252) 975

e-mail: cypresscam@embarqmail.com) on a form that includes a description
of the kayak/canoe (i.e. make, color, length, etc.) and a liability
waver. See attachment. The CAM will have “day-to-day” administration
authority which includes the assignment to specific numbered spaces and
the right to reassign spaces in the interest of the best overall
utilization of the facility.
It is the specific responsibility of authorized users of these
storage areas that all information on the storage “application” is
current and complete at all times and that a signed liability waiver is
on file. Any change in storage information or intended usage shall be
immediately provided to the CAM.
3- Space Allotment/Assignment
Spaces will we assigned yearly by the CAM, and if the requests for
spaces exceeds the availability, a lottery will be used. The yearly
applications will be submitted to the CAM (phone: (252) 975 3255 e-mail:
cypresscam@embarqmail.com) and limited to two (2) spaces per Cypress
Landing property owner. The CAM will call for annual applications via
the community e-mail system. Applicants must already own a kayak/canoe.
If the number of applications exceeds the number of available spaces,
spaces will be assigned via a “lottery” system. Once all spaces
have been assigned to those who already own a kayak/canoe, a wait list
will be created from the remaining lottery results, placing applicants
on the wait list in the same order as the lottery results. When a
space becomes available, the CAM will notify the next applicant(s) on
the wait list until the space is filled.
In assigning spaces, the CAM will give consideration to special
height requests, to the extent possible. Once a space is assigned, that
space will be designated for the sole use of the property owner to whom
assigned subject to reassignment by the CAM, as necessary. Canoes will
be assigned to the spaces within the dumpster enclosure.
4- Audit/Compliance
The contents of all storage areas will be audited at least twice
annually by the CAM in conjunction with the Building & Grounds
Committee. Users of the storage areas are requested to notify the CAM
when a space will be empty for an extended period of time or is no
longer required or when the item(s) being stored differ from what is
shown on file.
5- Security
Should a hurricane or storm be imminent, space holders are
responsible to either remove or secure their stored kayaks/canoes. Space
holders are permitted to secure their kayaks/canoes with locking
devices. Paddles and other equipment are not to be stored in the
facilities.
6- Maintenance
The storage areas are intended to be a “no cost” amenity. Space
holders may be contacted at the discretion of the CAM to move their
kayak/canoe and requested to assist with maintenance.
7 – Association (CLMHOA) indemnification:
The space holder acknowledges and agrees to indemnify and hold
harmless the Association (CLMHOA) from any and all claims, loss, damage,
theft or storm damage to any property arising out of the use of the
storage area and the space holder releases and indemnifies the
Association from any and all claims, losses, liabilities, demands,
actions, or causes of action of any kind or character, including,
without limitation, attorneys fees, costs and expenses, whether known or
unknown, arising out of the space holder’s use of the storage area.
Space holders are responsible for any damage that their kayak/canoe may
cause to other kayaks/canoes, boats docked in the marina, other private
and/or community property as a result of high winds and/or storms.
