| Maintenance
of Undeveloped Home Sites:
As set forth in the Covenants of Cypress Landing, all undeveloped home
sites will be mowed at least once per year at the end of the plant growth
period during September through November. This mowing will be arranged by
the Community Association Manager (CAM) and the owners of the undeveloped
home sites will be billed the cost of such mowing. A waiver of this
requirement may be granted by the CAM if the home site in question is to
be cleared for development by no later than April 1 of the following year.
Additionally, on some undeveloped home sites trees downed by storms and
disease create unsightly conditions and diseased and damaged tree impose
dangerous conditions. Owners of such home sites are required to remove/
have removed all downed trees or trees that impose a safety hazard prior
to September of each year to permit the safe and efficient mowing of the
home sites.
Annually, by no later than June 1 of each year, the CAM, with the
assistance of the Building and Grounds Committee, will identify the
undeveloped home sites with downed trees and will provide notice to home
site owner that the downed trees must be removed by September 1. As part
of the notice the CAM will identify local contractors who may be used by
the home site owner to accomplish the tree removal. The CAM may grant a
waiver of this requirement (except for the removal of trees that impose a
safety hazard) if the home site in question is to be cleared for
development by no later than April 1 of the following year.
If the tree removal is not accomplished by September 1 and a waiver has
not been granted to the home site owner, the CLMHOA Board will take action
to have the lot cleared and will bill the home site owner for the costs
incurred.
Maintenance of Developed Home Sites with Natural Areas Facing the
Street.
To ensure a uniform appearance throughout the community, the owners of
developed home sites with natural areas facing the street shall have such
natural areas mowed and cleared of any downed trees or trees that impose a
safety hazard at least once per year in September or October. When the
mowing of the natural areas is to be accomplished, the home site owner may
identify specific young trees and shrubs to be retained. This maintenance
will produce an end result similar to the final appearance of undeveloped
home sites following the annual mowing.
Annually, by no later than August 1, the CAM, with the assistance of
the Building and Grounds Committee, will identify the developed home sites
that require maintenance and will so inform the owner of the site.
The home site owner may accomplish this annual maintenance or may
arrange to the maintenance contracted through the CAM. If the latter
option is chosen, the CAM will bill the home site owner for the contracted
cost. |
