Cypress Landing Marina Slip Use Policy
Borrowed Slips
The Cypress
Landing Marina Association has determined that from time to time boat owners
are docking their boats in slips for which they have they have not obtained
either an annual or long term lease. This practice of using slips “borrowed”
from long term lease holders is not permitted by slip holder lease
agreement.
Even though the slip holder may not be receiving rent or other compensation,
a careful legal review has determined that this practice constitutes the
functional equivalent of a sub-lease which is not permitted under paragraph
#14 of the slip holder lease.
The failure of the boat owner to have signed either an annual or long term
lease means that the owner cannot be held to any or all of the conditions
required in such a lease to include, but not limited to, paragraph #23
[Exculpation/Indemnification of the lessor],
paragraph #10 [Equipment] and paragraph #13 [Insurance] putting the Cypress
Landing Master Homeowner Association [owner and master lease holder] and the
Cypress Landing Marina Association [operator and maintainer] at significant
risk concerning operations and liability. In addition, the Coastal Area
Management Agency (CAMA) permit for the marina prohibits transient leasing
arrangements.
Permanent docking is restricted to persons entering into annual or long term
slip leases. A boat owner who has leased a current slip holder’s residence
within the community and is residing full time in that leased property has
docking privileges during the lease period. Boat owners desiring to dock
their boat at Cypress Landing are required to purchase an annual or long
term lease.
Visiting Boats
The docking policy for non-resident visitors who arrive by boat is as
follows:
1. Cypress Landing Yacht Club reciprocal agreements allow for short term (up
to 7 days) docking privileges that provides for first night at no cost and
$10.00 per day for utilities thereafter.
2. Boaters who are visiting as house guests of a resident slip holder have
docking privileges for short term (up to 7 days) at no cost for the first
night and $10.00 per day for utilities thereafter.
3. Temporary tie up positions are limited to the outside of the
T-heads only and reservations must be made before arrival with the head dock
master.
