As Cypress Landing becomes a mature community with more residents moving
in, there is greater concern over the impact of continued construction,
specifically with destruction of paved roads, road shoulders, drainage
swales and with mud being carried onto the roads. Site maintenance is also
frequently unacceptable because of construction debris and personal trash
blowing onto adjacent home sites. These conditions are unsightly, are a
nuisance to adjacent home owners and can represent a potential safety
hazard.
At the beginning of this year, The (ACC) developed a monthly inspection
process with a FAX message reporting system to address these issues. This
system does not work to the satisfaction of the Board.
Without WREDCO to actively oversee construction, the ACC was directed to
amend the Building Guidelines to ensure compliance with Protective
Covenants and Building Guidelines and maintain an ongoing record of
construction and ACC decisions. The revised Building Guidelines enclosed
are also posted on line at www.cypresslandingnc.com. Additional copies are
available upon request by mail, telephone (252-975-3255) or in person from
the Community Association Manager (CAM) in the Bay Club. The significant
changes outlined in the revised Building Guidelines are as follows:
(1) In addition to the Application for Architectural Review, all Lot
Owners constructing a new living unit are required to post a $1,000.00
dollar non-interest bearing Performance Deposit with their Application
along with a check in the amount of $300.00, for delivery of a Cypress
Landing Mail Box and administrative costs.
(2) At the end of construction, the Lot Owner must meet with the ACC at
the home site for a field review. This review is to verify that the
proposed construction represented in the application was properly built
and that all requirements of the Building Guidelines are met. If
acceptable, the Performance Deposit of $1,000.00 dollars will be returned
to the Lot Owner, less any deductions, along with a signed copy of the
“Completion of Construction Form”.
(3) All construction sites will be inspected monthly and on an as required
basis. For any violation, the Lot Owner and Builder/Contractor will
receive a copy of the ACC Inspection Form by mail or FAX, specifying the
nature of the violation(s). Since Builders/Contractors work on behalf of
the Lot Owner it is the Lot Owner who bears the ultimate responsibility to
ensure that Builders/Contractors correct the violation(s) and comply with
the provisions of CLMHOA Protective Covenants and Building Guidelines.
It is important that any Lot Owner or Resident planning construction or
remodeling become familiar with the requirements outlined in the revised
Building Guidelines before any work is started.
